Terms & Conditions for Drivers

This document sets out the terms and conditions for customers making use of a Mazda Care Courtesy Vehicle, provided by Mazda Southern Africa (Pty) Ltd ("Mazda") or one of its authorised dealers.

By accepting and operating a Courtesy Vehicle, you ("the Driver") agree to abide by the following rules and conditions.

1. Purpose & Ownership

  • The Courtesy Vehicle is provided temporarily while your own vehicle is undergoing scheduled service or warranty-related repairs.
  • Mazda retains full ownership of the vehicle at all times.
  • You may not sell, rent, or allow others to use the vehicle unless specifically authorized.

2. Who May Drive the Vehicle

  • Only the approved customer (or additional drivers authorized by the Mazda Dealership) may operate the vehicle.
  • All drivers must:
    • Hold a valid South African driver’s Licence for at least 3 years
    • Have no criminal record or outstanding traffic fines
    • Provide certified ID and driver’s licence copies upon request

3. Usage Limitations

The vehicle may not be used for:

  • Commercial use (e.g., Uber, Bolt)
  • Racing, track days, or off-road driving
  • Driving outside South Africa
  • Any activity that violates the vehicle’s insurance policy

4. Driver Responsibilities

  • Always drive lawfully and responsibly
  • Do not tamper with safety features or tracking devices
  • Return the vehicle clean and in good condition (normal wear and tear accepted)
  • Lock and secure the vehicle when not in use

 

5. Mileage Limit

  • The daily driving limit is 200 km.
  • Any excess mileage may be billed to you based on the dealer’s discretion

 

6. Fuel & Cleanliness

  • The vehicle must be returned with at least a quarter tank of fuel.
  • The vehicle should be reasonably clean upon return.

7. Insurance Cover

  • The vehicle is covered under Mazda’s fleet insurance.
  • In the case of an incident/accident, you will be liable for an excess of R4,500 per occurrence.
  • You are fully liable in cases of:
    • Gross negligence
    • Driving under the influence
    • Allowing unauthorized drivers to use the vehicles
  • Please note that the Mazda Fleet insurance policy does not provide cover for the loss, theft, or damage of any personal items left in the vehicle. We recommend that all personal belongings be removed from the vehicle when unattended to avoid potential loss, as such items are not included under the insurance coverage

8. Accidents & Incidents

If an accident or damage occurs:

  1. Report the incident to the Mazda dealership immediately
  2. Report it to the SAPS within 24 hours and obtain a case number
  3. Submit a completed insurance claim form within 3 days to your dealership.
  4. No repair work is allowed to be carried out on Mazda Southern Africa’s vehicles

9. Fines & Offences

  • You are fully responsible for any traffic fines, parking tickets, or violations.
  • Liability for any fine may be transferred to you by Mazda.
  • No smoking, including e-cigarettes, is allowed in the vehicle.

 

10. Tracking and Monitoring

  • The vehicle may be tracked at any time for safety and usage purposes.
  • You consent to monitoring for compliance and security.

 

11. Prohibited Conduct

You may not:

  • Allow unapproved persons to drive the vehicle
  • Use the vehicle for illegal, immoral, or dangerous activities
  • Modify or add accessories without written consent

 

12. Return of Vehicle

  • The vehicle must be returned on or before the agreed date and time.
  • Failure to return it may result in:
    • Mazda reclaiming the vehicle without prior notice
    • You being held liable for any related losses or damages

13. Legal and Financial Liability

  • You agree to indemnify Mazda against any loss, damage, or legal claims arising from your use of the vehicle.
  • You must notify Mazda immediately of any legal correspondence or insurance communication related to the vehicle.
